Information you provide to us. Personal information you may provide to us through the Services includes:
Identification information: including your name, email address, phone number, company name, date of birth, signature, and photos of your driver’s license and/or passport.
Communications: When you contact us with questions or feedback, respond to one of our surveys, or otherwise communicate with us, we may collect the information in such communications.
Payment and transactional information: we collect information needed to process your orders or transmit direct deposits to you, including tax ID/Employer Identification Number (“EIN”), last four digits of your Social Security Number (“SSN”), payment card information, bank account number and related information, billing information, legal business name, doing business as name, business address, personal address, date of birth, job title, and transaction history.

Plaid: Honeybook also collects bank account numbers to transmit direct deposits to Businesses. If you elect to link your bank account automatically through the API provided by Plaid Inc. (“Plaid”), HoneyBook will also receive information related to the transactions associated with that account, including the transaction ID, transaction category and type, merchant name, amount, currency, date, and location. By using the Plaid API, you grant HoneyBook and Plaid the right to access and transmit your personal and financial information from the relevant financial institution and you agree that your personal and financial information will be transferred, stored, and processed by Plaid in accordance with Plaid Privacy Policy.
Marketing information: such as your preferences for receiving our marketing communications and details about your engagement with them.
Third-party account information: if you choose to connect third-party accounts to the Services, we may collect information associated with your third-party accounts, such as the name, email address, and profile information you provided to the relevant third party. Marketing and advertising: We and our advertising partners may use your personal information for marketing and advertising purposes, including:

Direct marketing. We or our advertising partners may send Businesses and clients of Businesses who use our Services direct marketing communications as permitted by law, including, but not limited to, notifying you of special promotions, offers and events via postal mail, email, telephone, text message, and other means. We do not use Contacts’ Information for direct marketing.

Interest-based advertising. We engage advertising partners, including third party advertising companies and social media companies, to display ads on the Services and other online services. These companies may use cookies and similar technologies to collect information about your interaction (including the data described in the “Automatic data collection” section above) over time across the Services, our communications, and other online services, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms. Public profiles: We may use Contacts’ Information (excluding Gmail Information and other information collected from Google services such as Gmail, Contacts, and Calendar), together with other publicly available information, to create public profiles for individuals who we think may be interested in our Services. Once we have created a profile, we may suggest that other users of the Services connect with the created profile. If any users take an action on the created profile, we will notify the profile owner so they may claim their page. If we have created a public profile for you, we will provide an "opt-out" link at the bottom of the profile if you wish to have your profile deleted.
Connections and Invitations: We may also use Contacts’ Information to suggest connections and to enable you to invite others to use our Services and connect with you. It is your choice whether to invite someone to our Services. For clarity, if an invitee accepts the invitation, then the invitee shall be subject to the terms and conditions of this Privacy Policy and our Terms of Service. We may also receive personal information about you when others import or sync their Contacts’ Information.

Advertising partners: Third party advertising companies and other third parties, including HoneyBook’s parent, affiliates, other brands and business partners for commercial purposes like the interest-based advertising purposes described above.
Professional advisors: Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.
Authorities and others: Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.

Please keep in mind that whenever you voluntarily make your personal information available for viewing by third parties or the public on or through the Services or posting via SMP, that information can be seen, collected and used by others. We are not responsible for any use of such information by others.

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe and we cannot guarantee the security of your personal information. You use the Services at your own risk.
Processing of Data in the U.S.
We are headquartered in the United States and may use services providers that operate in other countries. Your personal information may therefore be processed in the United States or transferred to other locations where privacy laws may not be as protective as those in your state, province, or country.
Children
HoneyBook does not sell products for purchase by children under the age of 13. If you are under 13 years of age and should not be used by such children. If we learn that we have collected personal information through the services from a child under 13 without the consent of the child’s parent or guardian, we will delete it.

We are providing this supplemental privacy notice to consumers in California, pursuant to the California Consumer Privacy Act of 2018 (“CCPA”).

To verify your identity prior to responding to your requests, we may ask you to confirm information that we have on file about you or your interactions with us. Where we ask for additional personal information to verify your identity, we will only use it to verify your identity or your authority to make the request on behalf of another consumer.
Authorized agents: California residents can empower an “authorized agent” to submit requests on their behalf.
Privacy Shield
HoneyBook complies with the EU-U.S. and Swiss-U.S. Privacy Shield frameworks (“Frameworks”) as set forth by the U.S. Department of Commerce regarding the processing of personal data transferred from the EU and Switzerland to the U.S. (for these purposes, reference to the EU also includes the European Economic Area countries of Iceland, Liechtenstein and Norway). HoneyBook has certified that it adheres to the Privacy Shield Principles (described below). If there is any conflict between the policies in this Privacy Policy and the EU or Swiss Privacy Shield Principles, the Privacy Shield Principles shall govern. General. We rely on our Privacy Shield certification to transfer personal information that we receive from the EU and Switzerland to HoneyBook in the U.S. and we process such personal information in accordance with the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability (“Privacy Shield Principles”), as described below.
Notice And Choice. This Privacy Policy provides notice of the personal information collected and transferred under the Privacy Shield and the choice that you have with respect to such personal information. It also provides information about other Privacy Shield Principles that are set forth below.

Client Gallery Portal
We are committed to protecting the privacy of your data and this policy explains what we collect and how we use your personal information. This policy may be amended as we release new features, or when legal requirements arise. We encourage you to review this policy from time to time to stay informed of any changes that might affect you.
1. Definitions
When we say “Pixieset”, “we”, or “us”, we are referring to Pixieset Media Inc. Pixieset provides users with tools to help them create and manage client galleries and more through the use of its web application, website hosting services and other tools and services (the "Services”). When we say “Users”, we are referring to customers who are visiting our site or are using our Services. When we say “Clients”, we are referring to customers who are visiting or using our Users’ sites.
2. What information do we collect?
Account Information: To create an account, we collect your email address, business name, business website. To use the Services, we collect the information you voluntarily provided through your Account, including information about your Clients that you share with us (email addresses, names). For Clients who use the store functionalities in your gallery, we collect the information Clients provide during checkout.
Log data: When you access or use our website or services, our servers will automatically record log data which may include IP addresses, device and browser configurations, date and time of access, browsing times and loading errors if applicable.
Usage data: We may collect data on how you use the Services, such as gallery creation date and time, timestamps of communications you sent out via the account.
Information from third party services: We may collect information through other services you integrate with (such as Lightroom), information collected will be all in accordance with the authorization procedures of the services.
Additional information: We may collect additional information when you contact us for support, communicate with us via social media channels or contact us through third-party services.
3. How do we collect your information?
Information you provided directly: When you sign up for an account or use the Services, you provide account and transaction related information through your account. These may include your profile information, Client’s name, email and photos, your communication preferences. For Clients, these may include billing/shipping information provided when purchasing from a gallery.
Information from your use of the site and Services: When you visit the website or use the Services, we collect information of your activity and usage from your interaction with the site. These may include your IP address, browser and device information, timestamps of your interactions on the site. These information is mainly collected automatically using cookies or other similar technology. You can read more about our Cookie Policy here.
Information from other sources: We may collect information from other services such as third party service providers, payment processors, or advertising services. These may include device and location information, limited information on your card used for payment, prior visits to our website, or whether you opened an email campaign.
4. How do we use the information we collect?
We use the information collected primarily to provide you with the Services you signed up for and to support our legitimate interests in operating our Services and business.
To provide you with the services you signed up for: We will use the information you provided to enable you to create galleries, websites, to communicate with your Clients, to facilitate payment and order processing and any other services requested by you. This also includes sharing this information with third-party service providers in order to provide the services (such as emailing a Client). When we need to share information, we take the steps to ensure that only the necessary information is shared, and the information is protected and being used in accordance with this policy.
To maintain and improve our services: We use the information collected to analyze our site performance and measure the usage of features.
To verify your identity: When we need to authenticate your account to provide you support, or if concerns arise in regards to identity theft. We use the information to verify your identity.
To personalize your experience and advertise our services: We may use the information to conduct our advertising and marketing campaigns and referral program. You may opt out of certain ad targeting and retargeting services with the third-party advertising networks directly.
To communicate with you about our services: We will send you emails about transactions on your account, technical notices, and feature announcements. You may change your notification settings in your account, or contact us at any time.
To provide you with support: When you contact us for help, we will use the information to assist you in your use of the Services.
To meet legal requirements: We may need to use the information to comply with legal requests such as court orders, request by public authorities, and any other other appropriate legal mechanisms.
5. How do we share the information we collect?
Third-party Service Providers: We share your information with our third-party Service Providers who provide and support our Services. We will only share information that is necessary for the third-party to complete the service and require them to use the information a manner that is consistent with this policy. Examples of Service Providers include hosting and content delivery services, customer support management services and payment processors.
User’s instruction: We will share and disclose the personal information only on your instruction, provided the are part of the functionality of the Services and they are in compliance with applicable law.
Change in business: In the case of a merger, acquisition, financing, reorganization or sale, information collected may be shared on the basis that it is subject to standard confidentiality arrangements.
To comply with the law: Information may be disclosed if it is deemed necessary to comply with the law and court order, to protect the rights of individuals and to fulfill law enforcement requirements.
Marketing: We may share information with third-party advertising networks (such as Facebook and Instagram) in order to deliver relevant advertisements to you and to manage our communications with you. We do not use your content for this purpose.
6. How do we protect the information we collect?
Pixieset follows industry standards on the management of personal information. We employ technical and administrative safeguards intended to protect against accidental or unlawful destruction, loss, alteration and disclosure of personal information. We maintain security measures such as the use of redundancies and employ firewalls to protect against unlawful access and network vulnerabilities. No method of storage and transfer of information over the Internet is absolute secure, while we have safeguards in place, we cannot guarantee the absolute security of your personal information.
7. Data Retention
We will retain your information for as long as your account is active or as long as needed to provide you with the Services. We may also retain and use your information in order to comply with our legal obligations, resolve disputes, to enforce our agreements and to protect our and others’ interests. We may continue to store your information for a reasonable amount of time after you cancel your paid subscription or becomes inactive, in the case that you wish to reactivate your account. You may delete your Account in your account dashboard or by contact us at privacy@pixieset.com, in which case your information will be deleted. Anonymized information that are not identifiable to a person might be retained to help us improve our Services.
8. International information transfer
As part of providing the Services to you, your personal information might be transferred, stored or processed in a country other than where you are located. Pixieset will ensure the transfers will be completed in compliance with mechanisms that is recognized under the relevant Data Protection Legislation as providing an adequate level of protection for data transfers. Specifically for residents of the EEA, we will ensure the data transfer is completed in accordance to the Standard Contractual Clauses (EU Model Clauses) and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).
9. Your Rights
You have the rights over your personal information. Subject to any exemptions provided by law, we take reasonable steps to allow you to access, correct, amend, delete, port, or limit the use of your personal information. You can usually manage your information simply by logging in to your account and editing your information directly in the dashboard. If you cannot perform these actions yourself, you can contact us at privacy@pixieset.com for assistance. Please note that we may ask you for proof of account ownership and/or identity before fulfilling your request.
If you are located in the European Economic Area (EEA), we will normally collect personal information from you only where, a) we have your consent to do so, b) where we need your personal information to fulfill a contract with you, or c) where the processing is in our legitimate interest in providing the services. In most cases, if you do not provide the requested information, we will not be able to provide the service to you.
If you are a User and wish to exercise these rights, please reach out to us at privacy@pixieset.com. If you are a Client of a User and wish to exercise these rights, please contact the User you interacted with directly -- we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.
